Prize Draw Terms and Conditions

1. Promoter

The promoter of this prize draw is Better Hamilton, an unincorporated community group based in Hamilton, New Zealand (“the Promoter”).

2. Eligibility

2.1 Entry is open to New Zealand residents aged 18 years or older at the time of entry.
2.2 Entry is not open to:

  • Members, staff, or contractors of Better Hamilton;
  • Immediate family members (defined as spouses, parents, children, or siblings) of the above.
    2.3 By entering the prize draw, entrants warrant that they meet all eligibility requirements. The Promoter reserves the right to verify eligibility and disqualify any entrant who does not comply with these Terms and Conditions.

3. Entry Mechanism

3.1 Entry into the draw is free and is made by completing and submitting the official online entry form available through the Promoter’s website or designated platform.
3.2 Only one entry per person is permitted. Duplicate or incomplete entries will be deemed invalid.
3.3 The entry period opens at 12:00 PM (midday) NZST on Monday 4th of August 2025, and closes at 12:00 PM (midday) NZST on Monday 1st of September 2025 (“Promotional Period”).
3.4 No responsibility is accepted for late, lost, misdirected, or incomplete entries.

4. Prize

4.1 The prize consists of a single payment of NZD $1,000 (one thousand dollars).
4.2 There will be one prize winner only, selected by random draw under supervision.
4.3 The draw will be conducted immediately after entries close at 12:00 PM on 1st of September 2025.
4.4 The prize will be paid via electronic bank transfer to a New Zealand bank account specified by the winner, upon successful verification of a current rates demand issued in the winner’s name.
4.5 If the Promoter is unable to contact the winner using the details provided within 48 hours of the draw, or if the winner is unable or unwilling to provide the required verification, the prize will be forfeited, and a new draw will be conducted.
4.6 The prize is not transferable, refundable, or exchangeable. No alternative prize will be offered.

5. Draw and Notification

5.1 The draw will be conducted by Better Hamilton, supervised for fairness and compliance, and will be final and binding.
5.2 The winner will be contacted via their preferred contact method (email, mobile, or phone) as indicated on the entry form.
5.3 Entrants are responsible for ensuring their contact details are correct and current. The Promoter accepts no responsibility for incorrect or unreachable contact details.
5.4 Entrants are responsible for providing the correct contact information i.e (correct and operable phone number or email address)

5.5 If a valid winner cannot be contacted within 48 hours, or fails to meet the eligibility requirements, a redraw will take place.

5.6 After the prize draw, Better Hamilton will endeavour to contact the winner by the preferred contact method up to 3 times.

6. Contact Preferences and Communication

6.1 As part of the entry form, entrants must indicate their preferred contact method:

  • Email
  • Mobile phone
  • Landline phone

6.2 Entrants may also opt-in to receive further information from Better Hamilton by ticking the “Would you like to receive more information?” box and providing an email address for this purpose.
6.3 Opt-in consent is voluntary and does not affect entry into the prize draw.

7. Privacy and Data Use

7.1 All personal information collected will be handled in accordance with the Privacy Act 2020 and used solely for:

  • Administering the prize draw;
  • Contacting the winner;
  • Optional communications if consent is given.
    7.2 All data collected will be permanently deleted once the draw is completed and the single prize has been successfully awarded.
  • 7.3 Personal information will not be shared with third parties unless required by law or with the express consent of the entrant.
    7.4 Entrants may request access to or correction of their personal information by contacting the Promoter at betterhamilton@gmail.com.

8. General Terms

8.1 The Promoter’s decisions regarding all matters related to the prize draw, including the selection of the winner, are final. No correspondence will be entered into.
8.2 The Promoter reserves the right to:

  • Cancel, suspend, or vary the prize draw or these Terms and Conditions at any time without prior notice (subject to applicable laws);
  • Substitute the prize with another of equal or greater value if the original becomes unavailable.
    8.3 To the maximum extent permitted by law, the Promoter accepts no liability for any loss, damage, or injury (including indirect or consequential loss) arising from or in connection with the prize draw or the awarding or use of the prize.
    8.4 The prize draw is conducted as a lawful promotion under section 5(2)(d) of the Gambling Act 2003.
    8.5 These Terms and Conditions shall be governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
